Favritz Terms of Service

Welcome to Favritz! These Terms of Service ("Terms") govern your use of the Favritz app ("App"), provided by Favritz Technology & Entertainment. By downloading or using the App, you agree to these Terms. Please read them carefully.

1. App Functionality and Services

Favritz offers a unique ranking algorithm and user interface to help you efficiently rank items from various categories and share these rankings with friends. Users can post comments, captions, and a profile image but no other forms of user-generated content. 

2. User Account

To use Favritz, you must be 12 years of age or older and will need to create a personal profile. Required information includes an email, password, display name, username, and date of birth. It's your responsibility to keep your account information secure. Parental guidance encouraged for users under 16. Favritz commits to creating a safe environment for young users. Favritz complies with children's privacy laws and no personal information from children is collected beyond what is necessary for the app's functionality.

3. User-Generated Content

You may post comments and captions on ranked lists. Favritz respects freedom of expression but does not tolerate hate speech or language harmful to others. User generated content is subject to timely moderation to prevent abusive behaviour and objectionable content. There is no tolerance for objectionable content or abusive users on apps available on the Apple App store or Google Play Store and Favritz will remove objectionable content and abusive users. Users are encouraged to report abusive comments, posts, or users by selecting Report Issue in the top menu of posts or profiles and block users as needed by selecting Block User on the abusive user's profile. Favritz will monitor reports and blocks as indications of whether a user is being abusive and must have their account permanently deleted. Depending on the severity of the objectionable content users may be sent an email with a written warning of their possible removal or removed immediately and made aware via email.

By posting, submitting, or otherwise making available any content to the Favritz platform, including but not limited to usernames, captions, comments, and rankings ("User Content"), you grant Favritz Technology & Entertainment a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content in connection with the Favritz Service and Favritz Technology & Entertainment's (and its successors' and affiliates') business, including without limitation for promoting and redistributing part or all of the Favritz Service (and derivative works thereof) in any media formats and through any media channels. You understand and agree that this license includes the right for Favritz to make such User Content available to other companies, organizations, or individuals who partner with Favritz for the syndication, broadcast, distribution, or publication of such User Content on other media and services.

Please note, Favritz will not use your profile pictures, personal information, or any content that can directly identify you without obtaining explicit consent from you separately.

4. Intellectual Property Rights

Favritz claims no ownership over trademarked images used for item identification in lists, which are considered Fair Use. Users can report improper use of images through the app. Favritz’s code and app design are protected under copyright laws.

5. Data Usage and Privacy

Favritz collects minimal personal data, including country identification but not specific location data. Aggregated data may be shared with advertisers to identify trends. No specific privacy controls are provided within the app beyond the ability to report content. Data stored by Favritz is protected by the secure services of Firebase and their services are responsible for protecting all Favritz data.

6. Liabilities and Limitations

Favritz aims for accuracy and reliability but does not guarantee the content's correctness. We will correct issues as quickly as possible during downtime or maintenance periods. Favritz bears no responsibility for disputes between users or reliance on app functionality.

7. Termination of Service

Favritz reserves the right to terminate or suspend accounts for hate speech, malicious actions, or harm to app functionality or other users. Upon termination, all associated user data will be deleted.

8. International Use and Compliance

While based in Canada, Favritz is available in all English-speaking countries. We claim Fair Use of images internationally but do not specifically address compliance with all international laws.

9. Updates and Modifications

Favritz updates the app regularly, with automatic updates through your device. Feedback can be provided via in-app reporting, our social channels, or the contact page on our website.

10. Contact and Communication

For support or to provide feedback, use in-app reporting, our social channels, or visit favritz.app/contact. Important notices, including changes to these Terms, will be communicated through in-app notifications.

Changes to Terms

We may modify these Terms at any time. You are advised to review these Terms periodically. Your continued use of the App after any modification signifies your acceptance of such changes.
